Terms of Service

1. Agreement and operator

These Terms govern access to BenchReels, a digital software service available through https://benchreels.com. “BenchReels,” “we,” “us,” and “our” refer to the seller operating the BenchReels service. The seller's legal identity and jurisdiction must be stated here before commercial launch.

By creating an account, subscribing, purchasing access, or using the service, you agree to these Terms, the Privacy Policy, Refund & Cancellation Policy, and Acceptable Use Policy. If you do not agree, do not use the service.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into this agreement. You must provide accurate account and billing information, keep your credentials secure, and promptly notify us of unauthorized access. If you use BenchReels for an organization, you represent that you are authorized to bind that organization.

3. The service

BenchReels is designed to help creators discover publicly available videos that may be relevant reference points. Users may submit a public video URL, a text description of an interest or niche, or a product brief. The service may generate discovery terms, retrieve public video information from supported platforms, rank candidates, and provide AI-assisted explanations.

BenchReels particularly attempts to surface examples where public view signals appear strong relative to a creator's public follower signal. Public metrics can be rounded, delayed, incomplete, or affected by promotion, brand relationships, celebrity, algorithmic distribution, and other factors that BenchReels cannot observe or verify.

4. AI-assisted output

BenchReels uses AI and automated processing to interpret your inputs, organize candidate videos, and explain potential relevance. Outputs are AI-assisted decision support. They may be inaccurate, incomplete, biased, or outdated and are not guarantees of future performance, organic reach, audience quality, sales, or account growth.

You are responsible for reviewing a video's context, rights, claims, and appropriateness before relying on it. You must not represent BenchReels output as professional, financial, legal, or platform-endorsed advice. AI outputs must be identified as AI-assisted where required.

5. Pricing, billing, and automatic renewal

The draft Starter plan is USD $19 per month, excluding applicable taxes. By subscribing, you expressly authorize recurring monthly charges to your selected payment method at the price shown at checkout. The subscription automatically renews each month until cancelled.

Prices, plan features, and billing terms may change. We will provide advance notice of material price changes where required and will not apply a new recurring price without the consent required by applicable law or payment-network rules. Checkout may show tax separately when required.

Card data is intended to be processed exclusively by our PCI-DSS compliant payment processor, Waffo Pancake, and is not stored on BenchReels servers. Transaction status, amount, and related billing records may be received from Waffo Pancake.

6. Cancellation

You may cancel from account settings when the subscriber portal is available, using the cancellation action made available in the paid product. Cancellation stops future renewal charges and takes effect at the end of the current paid billing period, unless applicable law requires otherwise. You remain responsible for charges already due.

Cancellation terms, refund eligibility, and billing-error handling are set out in the Refund & Cancellation Policy.

7. Acceptable use

You must use BenchReels lawfully, respect platform rules and intellectual-property rights, and comply with the Acceptable Use Policy. You may not use the service to facilitate prohibited or harmful content, evade access controls, scrape without authorization, misrepresent AI output, or interfere with the service or another person's rights.

8. Your inputs and outputs

You retain rights you hold in text and links you submit. You grant us a limited license to process those inputs to provide, secure, and improve the service, subject to the Privacy Policy. You must have the right to submit the information and must not upload private or confidential material that you are not authorized to share.

Subject to third-party rights, payment, these Terms, and applicable law, you may use generated reports for your internal or business purposes. BenchReels and its licensors retain rights in the service, software, ranking systems, interface, and original explanatory content.

9. Third-party services and public platforms

BenchReels may rely on public video platforms, infrastructure providers, payment services, and AI service providers. Their terms, availability, privacy practices, rate limits, and data access rules may affect results. A link or reference to a third-party video does not imply endorsement, partnership, or verification of that creator.

10. Availability and changes

We may update, limit, suspend, or discontinue features to maintain security, comply with law or platform requirements, control abuse, or improve the service. We do not guarantee uninterrupted or error-free operation or continued availability of any third-party data source.

11. Disclaimers and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED ACCESS. BENCHREELS DOES NOT GUARANTEE THAT A SHORTLISTED VIDEO IS ORGANIC, LEGAL TO COPY, OR USEFUL FOR YOUR AUDIENCE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENCHREELS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR LOST BUSINESS OPPORTUNITIES. THE FINAL LIABILITY CAP AND MANDATORY CONSUMER RIGHTS MUST BE CONFIRMED FOR THE SELLER'S JURISDICTION BEFORE LIVE PAYMENTS.

12. Suspension and termination

We may suspend or terminate access if you materially breach these Terms or the Acceptable Use Policy, create a security or legal risk, fail to pay, use deceptive conduct, or infringe another person's rights. Where appropriate, we may request corrective action first. Serious safety, fraud, or illegal-use concerns may require immediate action.

You may stop using the service at any time. Sections that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, and liability provisions, will continue to apply.

13. Changes and governing law

We may update these Terms and will post the revised version with a new date. Material changes will receive reasonable advance notice where required. The final governing law, dispute-resolution process, and seller legal identity must be completed before launch.
